1. General

These terms and conditions govern the use of the website of Nordic Retail Agencies BVBA ( with store- name MOOSE in the CITY) with company number 0833.229.604 its registered office at 2000 Antwerp, Ijzerenwaag 10-12 (hereinafter " the seller "). The terms of sale also apply whenever a reservation or order is placed through the webshop of MOOSE in the CITY via www.moose-in-the-city.com .
The website of Nordic Retail BVBA Agencies (MOOSE in the CITY) was created, commissioned and operated by the seller. Users may view the free information on the site and print for personal use but not for commercial purposes.
Minors or other incapacitated should be represented by their parents or legal representative who is also bound by these terms and conditions and must complete the order form itself or the incapacitated must grant explicit permission to do so, otherwise, the order will not be accepted. This will retain the provisions of art. 11 concerning the processing of personal data apply in full.
Anyone who places an order, confirmed by the order to be a natural person and not a trader or at least not ordering as a trader.
Placing an order on the website includes the acceptance of these terms and conditions. To place an order, accepting the terms is necessary. If you order, you are declaring to know the terms and conditions of the seller and you are accepting them. The general conditions are available and can be consulted on the website.
With each order, the general conditions, at that time recorded on the website and invoice, are applicable, with the exclusion of any older or newer provisions.
If one of these conditions for any reason would not be legally valid, the remaining conditions remain fully applicable.
What is not expressly provided in these terms and conditions shall be governed by the provisions of Belgian law.
The language of the agreements is Dutch. We advise contacting our customer service in case of ambiguity.

 


2. Offer and order

An order can be placed only through www.moose-in-the-city.com .
Orders are deemed to be placed for non-professional purposes through the website. These general conditions of sale, apply only to consumers (within the meaning of the Law on market practices and consumer protection of April 6, 2010). Merchants that want to place orders for personal use are advised to contact first our Customer Service.
The seller commits himself to process the orders, placed on the website, while stocks last and within the limits laid down in these conditions. The online order can only be processed if the customer is clearly identified CFR. according to Art. 9.
The seller reserves the right to refuse orders in case of serious suspicion of abuse of rights or bad faith, strongly suspected to seller unacceptable commercial purposes or to depletion of the stock of a particular article.
An order is only final after the acceptance of these general sales conditions, the prices and the description of the offer. If something in the offer or after order, was insufficiently clear, the customer can always contact the online customer service for further information through the contact form under ' contact us', or by e-mail at webshop@moose-in-the-city.com or by phone +32 ( 0 ) 3 369 06 06. All questions will be answered as soon as possible.



3. Payment

The prices are stated on the website at the time of ordering. All prices include 21 % VAT.
The cost of shipping will be specified when ordering before your order has been placed. It can then still be dispensed with the order. The specific costs of shipping by country (for a parcel, not large parcel) can also be consulted in the table below:
Free delivery for all orders over 100€ in Belgium.

Parcel and large parcel:

National
A parcel must not exceed 30 kilograms. Parcels over 30 kg and/or a surface area greater than 3m, subject to the rates of a large parcel
Following formats are allowed:
The minimum size is 145 mm x 112 mm
The longest side is up to 1.5 m
The total area of a pack should never be more than 3 meters
(1 x length + 2 x width + 2 x height = less than 3 m)
A shipment is automatically a package if it exceeds at least one of the following dimensions:
a width of 230 mm, a length of 350 mm, a height of 30 mm or a weight of 2 kg.

International
A Bpost World and a Bpost World Express may weigh up to 30 kg. Parcels over 30 kg and/or a surface area greater than 3m, subject to the rates of a large package
Following formats are allowed:
MThe minimum size is 153 mm x 240 mm
The longest side is up to 1.5 m
The total area of a pack should never be more than 3 meters
(1 x length + 2 x width + 2 x height = less than 3 m)
Maximum dimensions:
(1 x length + 2 x width + 2 x height = less than 3 m)
The longest side is up to 1.5 m
Roll size: length 

If payment is made by bank transfer, the order will be executed after receipt of the payment. Pending the ordered items will be reserved for 7 days period within which the transfer must have happened and pay the seller must have reached, if not the order will be invalidated.
It can also be paid with Moose gift certificates. If payment is made via the webshop with one or more gift certificates whose value exceeds the price paid, no refund is possible. When paying with a gift certificate in the MOOSE in the CITY-store, the difference in amount can be corrected by editing a new gift certificate.



4. Order confirmation

When the system has accepted the above payment, the seller confirms the order by e-mail.



5. Delivery

Delivery is currently only possible in the following countries: Belgium, Netherlands, Luxemburg, France, Germany, United Kingdom, Denmark, Finland, Italy, Monaco, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, United States, Canada, Japan.
The delivery of the ordered item(s) is done in Belgium or at the address given by the customer, by withdrawal in a post office or postal point, by withdrawal in a package dispenser Bpost 24/7 or by collecting at the MOOSE in the CITY - store of your choice. Delivery is done in other countries or at the address given by the customer or the chosen Belgian post office or postal point. The chosen option affects the delivery.
If the customer opts for shipping to an address, office/point or Bpost 24/7, an email will be sent when the delivery has been handed over to Bpost. Through the tracking number indicated therein, the customer can monitor the shipment via e-Tracker-Bpost. The customer who opts for the MOOSE in the City store, post office or postal point will receive an email once the shipment has arrived at the selected collection point.
The delivery period commences only upon receipt of payment, even if paid by bank transfer. We target for the shortest possible delivery time. The delivery is at least one day and up to 30 days after receipt of payment for delivery in Belgium, and between 2 and 30 days in other countries.
The seller is not liable for any delay or failure of delivery by a fault of the carrier.



6. Returns

Art. 46 Market Practices Act:
The consumer has the right to inform the company that he abandons the purchase without penalty and without giving any reason within 14 calendar days from the day following the delivery of the good.
Each ordered item can be returned within fourteen calendar days or exchanged for another article in the MOOSE in the CITY Store. The article should be in the shop delivered in the original packaging with the return form. The customer will be refunded by choice or receive a voucher.
The customer can also return the product within fourteen calendar days by mail. The article should be packed in the original shipping box and with the return, a form is sent to the following return address: NORDIC RETAIL AGENCIES BVBA, Ijzerenwaag 10-12, 2000 Antwerp, Belgium.
Return is always at the expense of the customer. Also returning from abroad, the customer bears the costs. A return can only happen after the buyer has requested and obtained a return-ID from the online customer service by e-mail.
In any case, a return is only accepted if the item has been sent back undefiled, undamaged and unworn and in the original packaging.
If a correct return in addition to any shipping charges, no fees, nor any compensations will be charged.
As the return has been handled by the seller, a refund will be done by using the initial payment choice of the consumer.



7. Warranty

Any problem or defect, with respect to the delivery of an article, damage or quality defect within seven days must be reported in writing by registered mail to the address: Nordic Retail Agencies BVBA, Ijzerenwaag 10-12, 2000 Antwerp, Belgium or via e-mail to webshop@moose-in-the-city.com.
In case of identified problems, the customer must report it to the online customer service within seven days of receipt. There will be an interaction with a solution come out. If the delivery is to be returned to the seller, this is done in the manner as stated under 7. The cost of shipment from Belgium and the Netherlands (providing a personalized label as described above under 7) shall be taken by the seller. For shipping from other countries, the customer is solely responsible for the costs.
The seller offers the guarantees provided by the law
The seller is not liable for odds, accident, misuse or wrong manipulation of an article by the customer.
An article with an acceptable claim will be repaired or replaced free of charge. If the costs of repair are disproportionate, the seller reserves the right to replace the item or exchange it with a similar product.



8.  Signature and proof

The customer accepts electronic evidence.
The customer is solely and exclusively responsible for the accuracy of any information that he or she provides to the seller.
In a first online order, the customer must follow the registration procedure. After that, the customer needs only to log in again to place a new order.
The final confirmation of the order by the customer implies acceptance of the order at the stipulated price. Ratification of the customer replaces the signature and full acceptance of all transactions via the website.



9. Liability for website use

The seller's website is intended to provide general information to the customer about the products and activities of the seller. Regarding access, the ordering process, delivery or other services, the seller has only an exercise commitment.
The seller is entitled to suspend in whole or in part at any time the site or put it on hold for maintenance, updating or any other reason, even without prior warning.
The seller can not be held liable for any inconvenience or damage arising from the use of the Internet, by any failure of the system, the intrusion of outsiders or of a virus, nor for any third party to this installed or processed information or any that can be regarded as force majeure.



10. Privacy protection

The information that the customer enters when placing orders are governed by the general privacy regulations of MOOSE in the CITY. The customer is responsible for the correct transmission of his / her data, as well as changes to this data. MOOSE in the CITY cannot be held responsible for the use of data modified by the customer but not passed on to MOOSE in the CITY

The seller reserves the right to gather for internal use customer data, both directly by collecting the data specified by the customer at registration and/or order and indirectly through the use of cookies, registration newsletter, reservation request or order.


The customer has in accordance with the Act of December 8, 1992, on the Protection of Privacy at all times the right to access these data, modify and delete if he/she no longer wish to receive information about the activities of the seller. For this, the customer can contact the online customer service of the seller. The customer can change his/her account details via his account profile.



11. Intellectual property

All parts of the site of the seller, including the technology used, are the exclusive property of the seller and copyrighted.
To set up a link between the seller's website and users, having their own website, but also for personal use, permission explicitly must be given by the seller.



12. Jurisdiction and applicable law

This agreement is subject to the provisions of Belgian law. In case of dispute, only the Court of the District or the Court of Appeal of Antwerp, have the jurisdiction.
